Georgia DUI attorney - 10 Day Rule

DUI CORPS

If convicted of a DUI in Georgia, part of your sentence will be attending an alcohol education program. The program, also known as ‘Alcohol Safety Action Program’ is actually mandatory for convicted DUI offenders in Georgia. These classes have been put in place to educate drunk drivers on the affects and harm alcohol has on the body, and to discourage offenders from drinking and driving again in the future.

Upon being convicted of a DUI in Georgia, offenders will undergo an assessment of their alcohol usage to determine the severity of their problems with alcohol. This evaluation costs anywhere from $250 - $350 and the offender must pay for it.

The program in Georgia is 20 hours long and will focus on drug/alcohol abuse, not only related to driving, but also the individual’s potential for alcohol and drug abuse. You will be required to submit a chemical test for drugs and alcohol in your system. If your test results come out positive, you will be re-processed for treatment.

The results of the assessment will not affect your final sentencing, but can be done before you receive your final sentence.

The state has a specialist who conducts the assessments.

For repeat offenders and those with high BAC’s, treatment is mandatory. All Georgia DUI offenders must attend the alcohol classes or treatment according to the assessment recommendation.

Offenders that do not comply with the program assigned may have further legal action taken against them and will not be eligible to have their driver’s license reinstated.

Georgia DUI offenders may also be placed on probation and have driver’s license restrictions imposed. Upon sentencing, the court requires offenders to enlist with the Alcohol Safety Action Program within 15 days. Failure to comply with this will lead to another court date where offenders can receive further punishment, including jail time.
