Challenging the BAC Results
Police officers administer various methods of field sobriety testing to determine a person’s blood alcohol content level (BAC). These tests include:
- Breathalyzer test
- Horizontal Gaze Nystagmus test (HGN)
- Walk and turn test
- One leg stand test
Out of the four methods, the Breathalyzer test is used the most. This lightweight BAC tester is easy to carry, easy to administer, and produces fast results.
With the breathalyzer test, the suspect is asked to provide a sample of breath into the small sized machine. If the machine detects an alcohol level over the legal limit, the suspect can be arrested and charged. However, not all BAC test results are accurate.
The breathalyzer machine is made to detect Ethyl alcohol, but it fails to differentiate Ethyl alcohol from Methyl alcohol. Various foods contain methyl alcohol, and people with diabetes tend to have high levels of methyl. If you consume substances that contain methyl alcohol, the breathalyzer machine can easily confuse it for Ethyl alcohol.
Other factors that can contribute to inaccurate BAC test results may include:
- Temperature conditions
- Breathalyzer malfunctions or improper use
- Blood or Vomit in mouth
- Dirt or smoke
- Moisture
