Field Sobriety Tests

When someone is pulled over in Georgia by law enforcement on suspicion of drunk driving, there are several standard ‘Field Sobriety Tests’ that the officer will conduct to determine if there is probable cause to arrest the driver for suspected DUI. There are three common Georgia DUI field sobriety tests that are used regularly by patrol officers. These tests are used to determine physical or cognitive impairment.

The first of these field sobriety tests is the “one leg stand”. The officer will have the driver stand on one foot with the other foot lifted about six inches above the ground and count out loud beginning at one thousand one. Typically the officer will let the driver continue counting in that same position for about 30 seconds. This test is about 65% accurate in determining impairment caused by alcohol.

The second widely used field sobriety test in Georgia is the “walk and turn” test. In this test, the suspected drunk driver must walk on a line for nine steps touching the heel of their front foot with the toe on their back foot. After taking nine steps in this fashion, the driver must turn (like an about-face) and walk back the same way. Studies have found that 65% of those who fail to complete this test successfully will be found to be legally impaired by drugs or alcohol.

The third common field sobriety test used in Georgia is the “horizontal gaze nystagmus”. A nystagmus is an involuntary twitch of the eyes that happens when someone looks to the side without moving their head. Nystagmus will occur at a lesser angle when the subject is under the influence, and they may have trouble following the object with their eyes. Most officers will use a pen light as a focal point, holding it about a foot away from the drivers face and moving it from side to side. When this test is performed correctly, research shows that this test will be correct approximately 77% of the time.
